Welcome to Vizhuthukal (the "App"). By downloading, accessing, or using our App, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App.
1. The Platform Role
Vizhuthukal acts solely as a connector (intermediary). We provide a platform for farmers and users to list livestock, machinery, and agricultural requirements.
Important: Vizhuthukal does not own, sell, or inspect any of the items listed. We are not a party to any transaction between buyers and sellers. Any agreement to buy or sell is strictly between you and the other user.
2. User Responsibilities
By using the App, you agree that:
- You are at least 18 years old and capable of entering into a binding contract.
- You will provide accurate, truthful information when creating an account or posting a listing.
- You are solely responsible for maintaining the confidentiality of your account login details.
3. Listing Guidelines (Selling)
When posting an advertisement ("Listing"), you agree that:
- Accuracy: The photos and description must accurately represent the current condition of the livestock or machinery.
- Health: You will not knowingly list livestock that is suffering from contagious diseases without disclosing it.
- Ownership: You have the legal right and ownership to sell the item listed.
- Prohibited Items: You will not list illegal items, weapons, or animals prohibited for trade under Indian Law.
We reserve the right to remove any listing that violates these policies without prior notice.
4. Buying and Trading
If you are buying an item found on Vizhuthukal:
- Verify Before Paying: You are responsible for inspecting the livestock or machinery in person before making any payment.
- No Liability: Vizhuthukal is not responsible for the quality, health, safety, or legality of the items advertised.
- Disputes: Any dispute regarding the transaction must be resolved directly with the seller. Vizhuthukal cannot mediate financial or quality disputes.
5. Prohibited Conduct
You agree not to:
- Use the App for any fraudulent purpose.
- Harass, abuse, or spam other users.
- Post content that is offensive, defamatory, or promotes hate speech.
- Attempt to hack, reverse engineer, or disrupt the App's servers.
6. Limitation of Liability
To the fullest extent permitted by law, Vizhuthukal and its developers shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App, including but not limited to financial loss, data loss, or disputes between users.
7. Termination
We reserve the right to suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in conduct that harms the community.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the courts of Tamil Nadu, India.
9. Content Safety & Zero Tolerance Policy
Vizhuthukal is committed to maintaining a safe environment for all users. We have a Zero Tolerance Policy regarding objectionable content.
A. Prohibited Content
Users are strictly prohibited from uploading, posting, or sharing content that includes:
- Child Sexual Abuse Material (CSAM): Any content that depicts, promotes, or facilitates the sexual abuse or exploitation of children. We will immediately report such content and the user details to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.
- Violence & Hate Speech: Content that incites violence, promotes hatred based on race, religion, or gender, or depicts cruelty to animals.
- Illegal Goods: Listing of weapons, drugs, or illicit items.
B. Reporting & Enforcement
We employ both automated systems and human moderation to detect violations. Users can also report inappropriate content via the "Report" button on any listing.
- Action: Any user found violating these policies will have their content removed immediately and their account permanently banned.
- Response Time: We aim to review and take action on reported content within 24 hours.
